Planning your inheritance is an act of responsibility and foresight. In Portugal, succession planning requires particular care, as the law places clear limits on how freely a person may dispose of their assets.

A well structured plan helps prevent family conflicts, reduces costs and provides legal certainty.

1. Understand the legal limits

The first step is to understand the Portuguese legal framework. Portuguese law protects certain close family members, known as forced heirs, who are always entitled to a mandatory portion of the estate.

It is essential to know:

• who the forced heirs are

• what portion of the estate is legally reserved for them

• what part of the estate is freely disposable

Without this understanding, any planning may prove ineffective or lead to future disputes.

2. Make a full assessment of your assets

Effective planning starts with a realistic overview of your assets.

This includes:

• real estate

• bank accounts and financial investments

• shareholdings in companies

• valuable movable assets

• existing debts

Both the composition and the value of the estate directly affect the calculation of the forced share and the available planning options.

3. Use a will strategically

A will is a central tool in succession planning, but it must be carefully drafted.

It allows you to:

• dispose of the freely disposable share

• benefit specific individuals

• organise succession in complex family situations

• reduce the risk of conflicts between heirs

However, a will does not override forced heirship rules. A poorly drafted will may be challenged and lead to lengthy court proceedings.

4. Be cautious with lifetime gifts

Lifetime gifts can have a significant impact on future succession.

In many cases:

• gifts are taken into account when calculating the forced share

• they may be subject to collation

• they may be reduced if they infringe the forced share

Gifting assets during your lifetime is not a shortcut to bypass succession law. It should form part of a coherent and legally sound strategy.

5. Plan to avoid an undivided estate

Undivided estates are one of the main sources of family conflict in Portugal.

Without planning:

• assets may become effectively frozen

• decisions require agreement between all heirs

• disputes may become prolonged and costly

Proper planning can greatly facilitate future division and significantly reduce these risks.

6. Take international elements into account

If there is any international element, such as:

• heirs living abroad

• assets located in different countries

• dual nationality

succession planning becomes even more important. In certain situations, it is possible to choose the law applicable to the succession, but this requires a technical and forward looking approach.

7. Seek specialised legal advice

Succession planning is not a single document. It is a process that must be adapted to the family structure, the assets involved and, often, an international context.

Standard solutions rarely work well in inheritance matters.

In summary

Planning your inheritance is an act of prevention, not mistrust.

In Portugal, efficient succession planning respects the law, protects family members and reduces future disputes. The earlier it is done, the greater the room for choice and legal security.
